Welcome to kneepads.com (the “Site”), operated by Tommyco Inc. (“Tommyco,” “we,” “us,” or “our”), a manufacturer of protective knee pads and related gear based in Delta, British Columbia, Canada. These Terms of Service (“Terms”) govern your access to and use of the Site, and any purchase you make through it or through our authorized sales channels, including Amazon.ca, Amazon.com, and Walmart.ca.
By accessing or using the Site, or by placing an order through any Tommyco-authorized channel, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products.
1. Who We Are
Tommyco has manufactured protective knee pads and related safety gear for over 40+ years, serving both wholesale/B2B customers and, through this Site and our marketplace storefronts, direct-to-consumer customers. Our products are backed by ISO 9001:2015 quality management certification and, where noted on individual product pages, CE certification for the applicable market.
2. Changes to These Terms
We may update or revise these Terms at any time. Changes take effect as soon as they are posted to this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
3. Eligibility and Account Use
- You must be at least the age of majority in your province or state of residence to place an order, or you must have the consent of a parent or legal guardian.
- You agree to provide accurate, current, and complete information when placing an order or creating an account, and to keep that information up to date.
- You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
- You agree not to use the Site for any unlawful purpose or in a way that could damage, disable, or impair the Site or interfere with any other party’s use of it.
4. Products, Descriptions, and Pricing
- We aim to describe our products, including proprietary technologies such as ZPZ (Zero Pressure Zone), T-Foam™, GELite™, Calf-Lock™, SCANDOLUS™, GEL-PRO™, and BRIDGE™, as accurately as possible, but we do not warrant that product descriptions, images, pricing, or other content on the Site are error-free, complete, or current.
- We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update product information, including pricing and availability, at any time without prior notice.
- Product availability may differ between the Site, Amazon.ca, Amazon.us Walmart.ca, Walmart.com, wholesale channels and other retail sites.
- Prices are listed in Canadian dollars (CAD) or U.S. dollars (USD) as indicated at checkout, depending on your storefront and location, and are subject to change without notice. Applicable taxes and duties will be calculated at checkout or, for marketplace orders, in accordance with that marketplace’s policies.
5. Orders and Payment
- Placing an order through the Site constitutes an offer to purchase, which we may accept or decline at our discretion — for example, in cases of suspected fraud, pricing errors, or inventory unavailability.
- Payment must be made in full at the time of order through the payment methods offered at checkout. Payment processing is handled by our third-party payment providers; please refer to our Privacy Policy for details on how payment information is handled.
- Orders placed through Amazon.ca, Amazon.com, or any other authorized third-party marketplace are also subject to that marketplace’s own terms, payment, and buyer policies, which apply in addition to these Terms.
6. Shipping, Delivery, and Returns
Shipping and delivery timeframes shown on the Site are estimates only and are not guaranteed. Please note that we are currently unable to ship to Hawaii and Alaska; see our Shipping Policy for full details and any other regional restrictions. We are not responsible for customs fees, duties, or import taxes that may apply to cross-border orders.
Our return and refund terms, including eligible timeframes and process, are set out in our Shipping & Returns Policy, which forms part of these Terms. Please review that policy before initiating a return.
7. Intellectual Property
All content on this Site — including but not limited to product designs, photography, text, logos, and the Tommyco name and marks — is owned by or licensed to Tommyco Inc. and is protected by copyright, trademark, and patent law. Tommyco’s proprietary technologies, including ZPZ, T-Foam™, GELite™, Calf-Lock™, SCANDOLUS™, GEL-PRO™, and BRIDGE™, are covered by utility patents held by Tommyco. You may not reproduce, distribute, modify, or create derivative works from any Site content or use our trademarks without our prior written consent.
8. Product Use and Safety
Our products are designed for the use cases and conditions described on the applicable product page and packaging. Certifications noted on a product page (such as ISO 9001:2015 or CE marking) apply to the specific product and market indicated and should not be assumed to extend to other products or uses. Always follow the fit, care, and use instructions provided with your product. Tommyco products are protective equipment intended to reduce impact and pressure on the knees during kneeling activities; they are not a substitute for other required personal protective equipment or workplace safety procedures.
9. Limitation of Liability
To the fullest extent permitted by law, Tommyco Inc. and its affiliates will not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site or our products, including but not limited to loss of data, revenue, or business opportunity, even if we have been advised of the possibility of such damages. Nothing in these Terms limits any liability that cannot be excluded under applicable Canadian consumer protection law.
10. Third-Party Marketplaces
When you purchase Tommyco products through Amazon, Walmart.ca, or another authorized third-party marketplace, that marketplace’s own terms of service, privacy policy, and buyer protections govern the transaction in addition to these Terms. We are not responsible for the availability, functionality, or policies of third-party platforms.
11. Termination
We reserve the right to suspend or terminate your access to the Site, or to decline to fulfill any order, at our discretion, including where we suspect misuse of the Site, fraudulent activity, or a violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
